You agree to indemnify, defend and hold harmless Basel Company and our parent, subsidiaries, affiliates, partners, officers, directors, agents, contractors, licensors, service providers, subcontractors, suppliers, interns and employees, harmless from any claim or demand, including reasonable attorneys’ fees, made by any third-party due to or arising out of your breach of these Terms of Service or the documents they incorporate by reference, or your violation of any law or the rights of a third-party.

SECTION 15 - SEVERABILITY

In the event that any provision of these Terms of Service is determined to be unlawful, void or unenforceable, such provision shall nonetheless be enforceable to the fullest extent permitted by applicable law, and the unenforceable portion shall be deemed to be severed from these Terms of Service, such determination shall not affect the validity and enforceability of any other remaining provisions.

SECTION 16 RETURN & CANCELLATION POLICY

RETURN POLICY

You may return most items within 14 days of delivery for one time exchange, this policy apply to original list price buyer, we will not consider any exchange on discount items & custom made items (eg. custom made watch band / made to order items). Before returning the items, please notify us by e-mail. You are responsible to pay the return postage unless the items we send is in-correct, is damaged, or is missing parts. Item(s) which show clear signs of use is(are) not qualify to return. The purchase becomes effective upon the expiry of the 14-day return period. Shipping costs are not refundable unless the item is damaged or defective.

Incorrect sent items must be returned back before we can send out the correct one. You will receive a shipping instruction for that. Same apply for repair exchange watches.

Refund will be made upon arrival of the item in one of our dedicated addresses.

CANCELLATION POLICY

Pre-Orders or orders can be cancelled at any time and the payment will be refunded 100%, if the order haven't been marked as processing in progress or shipped.

When you cancel your order, the following fee table apply:

*In this case we will need to reduce the shipping fee from the refunded amount. The total reduced amount is USD 40.00 from the refund.

17. Shipping and Delivery

Upon confirmation of payment your item will be processed for shipment within 2-8 business days (MON-FRI) start counting one (1) day after the order is paid (because of worldwide time difference). A tracking code will be issued to the email you registered with. For international tracked shipments, expect a 3-5 business day delivery time for express. Our shop will not be held responsible/reliable for lost goods if an incorrect shipping address is provided or delayed shipments (Due to any reason such as Christmas overload etc.). Please note that import taxes or others (VAT, custom clearance etc.) might be charged depending on your country and they are not included into the price and it is on your responsibility (feel free to contact us for any questions). The purchased goods are sent under DDU trading terms.

We usually ship with DHL Express Service, EMS or China Post. In case your address is marked as REMOTE from DHL System we switch to altnerative carrier without notification, the delivery time can then vary. If you wish to receive your parcel with different carrier, please contact our support center. Supported carriers: DHL Express, 1 Express, FEDEX, UPS, EMS, China Post.

In case of an unsuccessful delivery attempts to client, all costs (return-shipping, custom etc.) plus a handling fee of USD 20.00 must be paid by client/or will be deducted from the refund. We kindly remind you, it is customer's obligation to receive and sign for the package.

Defect or broken delivered es must be notifed us immeditaley after receipt or an appropriate amount of time after receipt. It is the customers obligation to check the for its functionality after receipt. Without notification, the is considered as arrived in good condition and fully functional. After this time the replacement shipment, return shipment has to be paid by buyer. Thank you for understanding.

Your order has been packed and left the Warehouse. It on the way to our international freight forwarder.

Your order has been successfully shipped out by our forwarder. You receive the tracking number the same time. Until this status up to 3 days could needed.

REFUNDED

Your payment has been refunded according to our cancellation/refund policy.

CANCELED

Your order has been successfully canceled.

SECTION 18 - DISCOUNTS

We usually grant a discount to bulk buyers, e-mail subscripers and bigger forums member.

Lucky Punch Deals and Pre Orders are generally excluded from promotions since their price drop is already high and limited. Only if specific mentioned, further discounts may apply.

SECTION 19 - WARRANTY

Your Wicked Watch GmbH is backed by a comprehensive warranty from the original date of purchase against all manufacturing defects for 24 months . The only components covered under warranty are the hands, dial, and watch movement. If the timepiece proves to be defective in workmanship or materials under normal use, it will be repaired free of charge at the discretion of one of our Repair Centers or replaced. Please note that a return shipping fee will apply to all warranty service.

(a) Damage, accidental or otherwise, to the watch while in the possession of a consumer not caused by a defect in material or workmanship.

(b) Damage caused by accident, misuse, tampering with or failure to follow the care and special handling provisions in the Instructions.

(c) Damage and/or scratches to the finish of the case, crystal, bracelet, strap or other components caused by wear or accident.

(d) Moisture damage to a watch not marked ‘water resistant’ on the case back or damage from moisture in ‘water resistant’ models that is a result of opening the watch, broken or damaged components.

(e) Steam damage to any kind of watch

(f) Damage caused by the consumer’s failure to have the watch serviced at the consumer’s expense in accordance with the following schedule of regular maintenance.

(g) unauthorized opening of casebacks will lead to immediate termination of warranty.

SECTION 20 - TERMINATION

The obligations and liabilities of the parties incurred prior to the termination date shall survive the termination of this

agreement for all purposes.

These Terms of Service are effective unless and until terminated by either you or us. You may terminate these Terms of Service at any time by notifying us that you no longer wish to use our Services, or when you cease using our site.

If in our sole judgment you fail, or we suspect that you have failed, to comply with any term or provision of these Terms of Service, we also may terminate this agreement at any time without notice and you will remain liable for all amounts due up to and including the date of termination; and/or accordingly may deny you access to our Services (or any part thereof).

SECTION 21 - ENTIRE AGREEMENT

The failure of us to exercise or enforce any right or provision of these Terms of Service shall not constitute a waiver of such right or provision.
